He flagged an appeal.<\/p>\n<div id=\"adspot-300x250-pos-3\"><noscript>&lt;iframe id=&#8221;dcAd-1-3&#8243; src=&#8221;http:\/\/ad-apac.doubleclick.net\/adi\/onl.smh.environ\/environ\/conservation;cat=environ;cat1=conservation;ctype=article;pos=3;sz=300&#215;250;tile=3;ord=7.1282037E7?&#8221; width=&#8217;300&#8242; height=&#8217;250&#8242; scrolling=&#8221;no&#8221; marginheight=&#8221;0&#8243; marginwidth=&#8221;0&#8243; allowtransparency=&#8221;true&#8221; frameborder=&#8221;0&#8243;&gt; &lt; \/ifram<\/noscript>And Riswan Zein, a representative of the environmental group Yayasan\u00a0 Ekosistem Lestari, said if the judges were going to insist on mediation, they\u00a0 should have mentioned it earlier in the case, which began in October.<\/p>\n<\/div>\n<p>The case began when Aceh&#8217;s then governor, Irwandi Yusuf, signed a permit in\u00a0 August last year\u00a0 to allow the\u00a0 palm oil company PT Kallista Alam to set up new\u00a0 plantation in the environmentally sensitive Tripa peat swamp seven hours south\u00a0 of the province&#8217;s capital.<\/p>\n<p>Detailed maps presented to the court showed the concession was part of the\u00a0 Leuser Ecosystem, which is protected from development under Indonesia&#8217;s 2008\u00a0 national planning law.<\/p>\n<p>Large parts of the concession also consisted of peat swamp of more than three\u00a0 metres in depth, making it a valuable store of carbon dioxide. The area also is\u00a0 one of the last redoubts of the endangered Sumatran orangutan, whose population\u00a0 in the area is estimated to now only number in the hundreds.<\/p>\n<p>For all three reasons, permitting a plantation on the area and clearing it\u00a0 was illegal, the complainants argued.<\/p>\n<p>The Sumatra-based landscape protection specialist Graham Usher told the <em>Herald<\/em> the company had begun\u00a0 clearing the swamp by burning, which is\u00a0 also illegal. It has also dug two canals to drain it, he said.<br \/>\n<!--more--><\/p>\n<p>A spokesman for Mr Irwandi, who is running for re-election as governor on\u00a0 Monday, said he respected what the environmental groups had done in bringing the\u00a0 case, and the former governor would evaluate it.<\/p>\n<p>Without resiling from his decision to issue the permit, Mr Irwandi would &#8220;sit\u00a0 down and talk&#8221; with the complainants, the spokesman said.<\/p>\n<p>&#8220;I think this is what the court wants, that we have mediation,&#8221; he said. &#8220;But\u00a0 if they want to appeal, we have to go through the court procedure first.&#8221;<\/p>\n<p>Last year Indonesia&#8217;s secretary-general of the Ministry of Forestry, Hadi\u00a0 Daryanto, told the <em>Jakarta Post<\/em> that the PT Kallista Alam permit was\u00a0 &#8220;clearly a violation because the area in question is a peat forest&#8221;.<\/p>\n<p>&#8220;On the moratorium map it&#8217;s clearly marked out as protected, but in the\u00a0 revision that followed, it was somehow excluded.
